  • RNC Constable Joe Smyth Found Guilty of Obstruction of Justice

    RNC Cst. Joe Smyth has been found guilty of obstructing justice.

    Provincial Court Judge Mike Madden says there is no doubt the traffic light in question was green. Smyth was charged with one count of obstructing justice following a traffic stop on May 5, 2017.

    Cst. Smyth pulled over a motorcycle that had just proceeded through an intersection, and issued the driver four traffic tickets. One of them was for running a red light—however evidence presented during trial confirmed the bike had a green light.

    In handing down his decision, Judge Madden said Smyth’s testimony did not add up to the video evidence. The judge says however you calculate it, the bike had a green light. He does not believe the officer saw what he believed to be a red light, despite what the officer testified.

    The judge says at question here is whether or not this was a mistake or a falsehood on behalf of Smyth.

    In the end, the judge sided with the Crown and found him guilty as charged.

    A sentencing hearing has been scheduled for April 19.
