No Justice for the Victim :

What is wrong with our justice system??? Why would those judges even consider an appeal?

That criminal left his two innocent children in the water to drive several miles go get help. Didn't he have a cell phone as one news article reported?

Any loving parent would give their lives to save their children. Mr. Hart is as guilty as sin and should be kept behind bars.

Tina :

I was there at their funeral and he was trying to cry.It made me sick to be in the same room with him .I can't even believe they would even give him another trial after what he did.The living conditions the children were in was an indication there was something wrong!!

CJ :

This is the justice system everyone wants! Seriously. People cry civil liberties! civil liberties! at every corner even when it really isn't a breach of civil liberty but they want to push the boundary in court to get away with a crime.... The words have been twisted and perverted to the point that the criminal is always right and the victim wrong. It has been a process over time but this is the result of years of lawyer-speak and no one cares if you're guilty, just if someone heard you say or seen you do something at a time that was inconvenient for them...

Keep in there !! He doesn't deserve a life outside of those prison walls he's behind!!!

Shocked :

I couldn't believe my eyes when I seen this article here today! That man does not deserve a second chance!! He killed 2 innocent little girls!! If your a parent and you see your child fall into the water like that, you don't even stop for one second to think "I cant swim" your right in there after them, that's what a loving parent would do!!! keep him behind bars where he belongs!!!!!!

Lorne :

our system is flawed!
and this is evidence of more than one flaw.

police should have never been able to use such a tactic. If i lie to a police officer i can be arrested but then are taught to lie to us??

$300,000.00 of tax payers money and counting...

The system needs some up grades Mr Harper
get back to work.

I can only hope that the people who think he wasn't given a fair trail or entrapment was illegal maybe they could go and get the moose or rabbit who seen him do it. than maybe they can take credit for old fashion police work. what a bunch of bleeding hearts

Citizen :

I was absolutely dumb founded when I heard on the news that this man (and I use the word "man" very loosely) was to be given a new trial!!! And the reason the new trial was granted was even more unbeleivable! I guess murdering your two lovely little three year old twin daughters isn't stressful because Hart didn't seem to have any stress related seizures doing it! I suppose the stress is only felt when you actually get caught for the dispicable crime!!!

Sally :

It's just great that our justice system is so concerned about Mr. Hart. Too bad they have no concern for the victims...

Way to go Mr Hart. You will win this time around.

Before you know it he'll be out walking around and those two little girls will not get the justice they so deserve!! Makes me ill just thinking about it!

Trish :

This makes me sick to think he might get away with this. Our justice system is not fit if Hart walks. He should spend the rest of his days in jail. How could anyone let alone a father kill innocent children?

Jack :

Bobby, the Canadian Justice System is what caused this mess against Nelson Hart in the first place.

First, he was given an unfair trial because a judge failed to accommodate his disability, which is Epilepsy.

Second, the evidence was obtained illegally through a "Mr. Big" operation, and Police were too lazy to get other evidence.

Maybe if Police did old-fashioned detective work and other means to get evidence to convict Nelson Hart, and the courts make proper accommodations towards disabled people, there wouldn't be a new trial in the first place.

Hmmm - interesting comments here towards a man with a history of emotional / mental issues.....is this an indication of what we are becoming as a society.

Della :

waste of tax payers money..he should be sentenced to death himself

Posted: 9/18/2012 9:56:59 AM
Jack :

Because Nelson Hart was convicted of murder due to a dirty tactic used, the RCMP's "Mr. Big" method, he should not have been convicted in the first place.

In other countries, notably USA and Great Britain, Police are not allowed to use entrapment tactics such as "Mr. Big".

In the "Mr. Big" method, a Police Officer masquerades as a Crime Lord, get the suspect's help to commit a series of smaller crimes, gain enough trust in the suspect, use coercion and threats to prevent the suspect from breaking away, and then when he/she is at its weakest, confess to a crime.

Because the Mr. Big method uses threats and coercion on suspects when they are mentally at their weakest, and no other means of physical evidence are gathered such as DNA, it should be ruled inadmissible and Nelson Hart's murder conviction should be dismissed.

Souwester :

This is outrageous! It seems he has more rights than his dear children. What man watches his child "fall overboard" and then drive somewhere to get help??? Seriously justice system, get your act together.

Mar :

If he has a new trial and found innocent then there is no justice in this world. Justice would be a joke if this person is allowed free.

Posted: 9/18/2012 9:17:50 AM

He should stay in jail for the rest of his life.

This guy doesn't deserve another chance; he killed two little girls that didn't even have a chance to live life to its fullest! Our justice system is the craps! PERIOD!! Keep this guy behind bars for the rest of his life!

Yes, let him speak. Now that he's had 5 years to perfect his story.

Justice??????? :

I realize the judges have a job to do and the law system works on the 'Presumption of Innocence', but for this man to show undercover officers how he pushed 2 innocent kids, his own innocenct kids into the lake to drown, I think it is fitting that he meet the same fate. Bad enough we have to feed him, let alone have to finance another trial. Can't call him an animal, as animals will put their own lives at risk to defend their young.

A. Dad :

This is unbelievable. Now we have to watch and listen to all this again just because of a couple of minor loopholes. Not to mention costing us taxpayers hundreds of thousands of dollars again. Let him stay where he is.

I hope he rots in hell for what he did

Bobby :

I have officially lost any hope I may have had in the Canadian justice system. This is outrageous, and a complete waste of taxpayers dollars. This scum-bag should have been locked-up and forgotten about, long ago.
