The Crown wants five months in jail for a 37-year-old man from the Goulds who posted an intimate image of his girlfriend to Facebook.

Devon McKenzie Ruby pleaded not guilty to one count of publishing, distributing or selling an intimate image of a person without consent. Following a trial he was convicted of the crime.
Ruby and his then-girlfriend had gotten into an argument. They broke up. Afterwards, he posted an intimate photo of the woman as his profile picture and cover photo on Facebook. The image exposed the woman’s buttocks. She was wearing lingerie and was identifiable in the picture.
The Crown says the woman’s mother saw the photo, which was available on Ruby’s personal Facebook page for about six hours.

The Crown is looking for a five-month jail term and a ban from using social media.
The defence argues there is no evidence of how many people saw the photo, and no evidence it remains online. His lawyer says Ruby has no criminal record and is a contributing member of society. They want three months of house arrest, followed by two years probation. The defence also asked for the court to allow Ruby to travel back and forth to Alberta for work.
The judge will return May 7 with a decision on sentencing.
