A family from Conception Bay South is taking the town to court over a long-standing dispute over flooding and sewage backup.
Michelle Dyke, who lives on Baird’s Lane in Long Pond, claims her family’s home is constantly flooding. She says they can hardly use the water in the house because of sewage backup.
Mayor Terry French has visited the property several times and while he feels for them, he says the issue goes back a long way. Dyke believes the town is responsible and should fix it while French says their position is that the town is not responsible.
Dyke says a couple of years ago, the town altered the flow of water at the top of the lane to the detriment of her property.
She just wants it fixed and to be able not to have to choose between washing dishes and having a shower.
Mayor French says he will be able to speak in greater detail after the court case, which will be called Wednesday. Dyke accuses the town of refusing to hand over documents outlining the work which was done at the top of the lane but the mayor says that’s not true.
He says the lawyers representing the two parties are working through the matter, and that no documents would be withheld from a court case.
