The province’s Privacy Commissioner says the province should adopt laws to ensure Statutory Duty to Document when it comes to government decisions.
Michael Harvey wrote Muskrat Falls Commissioner Richard LeBlanc after the matter was raised during the course of the two year inquiry.
One of the more surprising details to emerge from the inquiry was the fact that not all meetings in which important matters were discussed or decisions made were documented. Harvey says Newfoundland and Labrador’s Access to Information and Protection of Privacy Act is among the best in the world.
While Harvey acknowledges it’s up to the Commissioner on whether or not to make recommendations on Statutory Duty to Document, it is something he’d like to see in law.
He’d like to see a legal requirement to properly document decisions. He says if there is ever a fear or question about whether something should not be written down, then a public servant can intervene and ensure they are written down.
