The final charge against a correctional officer in the death of an inmate at HMP, has been formally dismissed.
Ten guards were originally charged following the death of Jonathan Henoche in November 2019.
They faced charges of manslaughter and criminal negligence causing death, which were dismissed in December.
But one guard, Jeff Thistle, had faced an additional charge of failing to provide the necessities of life.
This morning, that too was thrown out, bringing finality to the case.
Late last month the Crown conceded there would be no further criminal proceedings against any of the guards.
That was based on a second medical opinion that concluded the victim may have died from a pre-existing heart condition during his run-in with the guards on November 6, 2019, adding there was no likelihood of conviction.
Henoche’s family is still pursuing a civil lawsuit against the province in the death.
