A legal dispute stemming from the last municipal election in the Conception Bay town of North River has been dismissed by the Supreme Court of Newfoundland and Labrador.
James Cummings, a candidate in the North River municipal election in September of 2021, disputed the results. He had originally been assigned the last council seat when the votes were counted on election night. However, he lost that position two days later following a recount, having been overtaken by his nearest rival by six votes.
According to the court, a judicial recount confirmed the outcome of the first recount. Cummings applied to the court under the Municipal Elections Act to have the election overturned and hold another vote, alleging irregularities in how the election was conducted.
The Supreme Court dismissed the application, ruling that Cummings failed to prove that any irregularities occurred affecting the outcome of the election.
