A local defence lawyer is calling for changes to the law that limits the amount of time children have to sue people who physically abused them.
In a letter to all MHAs, and copied to media, Eli Baker states while there is no time limit on the filing of criminal charges, there is a two-year limit on bringing civil actions in this province, unless the abuse is sexual.
Baker says that time limit doesn’t exist in most other provinces, creating a serious inconsistency with other jurisdictions.
He cited several horrific cases of abuse and torture in this province which the children, who are now adults, cannot pursue due to the time limit. Baker notes that flies in the face of the realities around child abuse, which is often exposed many years after it occurs.
He says MHAs have the power to change the law, and he has even forwarded the suggested legislative wording, adding he’s available day or night to discuss with any member of the House.
