The town of Witless Bay has suffered a legal blow after Justice Alexander MacDonald granted an appeal against the town by a property owner in the area of Ragged Beach.
Gary Churchill owns a property on Mullowney’s Lane and was granted approval by the town to install water and sewer at the property. That permit was later rescinded so Churchill appealed the case to the Eastern Regional Appeals Board, which determined it had no jurisdiction to hear the appeal.
Churchill then appealed to the Supreme Court. In his decision Justice MacDonald determined that the Board does indeed have jurisdiction to hear the appeal, and that Churchill is entitled to costs from the town of $1,100.
