The Office of the Information and Privacy Commission has ruled in favour of the complainant in a case involving the Royal Newfoundland Constabulary.
The complainant, who had been involved in a motor vehicle accident, received the full police file but some of the information had been withheld. As well, the vehicle collision report prepared by the investigating officer was withheld on the grounds that access to the report was protected by ATIPPA.
The RNC were concerned about releasing third party personal information but the commissioner ruled that such information had previously been released to the complainant through the Highway Traffic Act, so it would not be an unreasonable invasion of personal privacy to release that same information in response to an access to information request.
The information involved is the name of the towing company, the name of the company which owned the other vehicle involved, and generic description of the other vehicle involved.
