The owners of Urban Market 1919 on LeMarchant Road will learn if the City of St. John’s will be granted an appeal to get a formal definition of the word “occupancy”.
The matter stems from a previous battle over Ivy and Greg Hanley’s attempt to open their pop-up Christmas House in a neighbouring property.
In 2022, the Christmas House had to shut down due to what the Hanley’s at the time said amounted to “bureaucratic red tape.”
They thought the matter was put to bed when the judge threw the case out for lack of evidence, but Ivy says, the city appealed.
“At 10:00 a.m. we’ll be at Supreme Court to see if they are granted the appeal or not.”
In the meantime, the Hanleys will not be opening their seasonal Christmas House this year because of the headaches involved.
She says they’ve decided not to open the pop-up store “until this (legal process) is completely closed out”
