Two local business owners are declaring victory after a judge threw out the capital city’s attempt to get a formal definition of the word “occupancy.”
The matter stemmed from a previous battle over Ivy and Greg Hanley’s attempt to open up a pop-up Christmas House in the old Brookfield Dairy building next to their Urban Market business on LeMarchant Road.
In 2022, the Christmas House had to shut down due to what the Hanley’s at the time said amounted to “bureaucratic red tape.”
They thought the matter was resolved at the time when the judge threw the case out for lack of evidence, but the city appealed. Because the matter was still in limbo, the Hanelys decided not to open the Christmas House this past season.
The Hanleys posted to Facebook last week, indicating that the long legal battle is now a “closed subject” and they look forward to “many more projects in the Brookfield district” with the desire to “grow our city and remove roadblocks for businesses.”
