Lawyers for Kurt Churchill are in Supreme Court this morning, appealing a ruling that included an order for a DNA sample.
The order was part of his sentence for uttering threats against an RNC officer on George Street in 2019.
Churchill was given a conditional discharge but was still ordered to provide his DNA for national police databanks.
The appeal of the order followed Churchill’s arrest for second-degree murder in the shooting death of James Cody.
That happened on Carigmillar Avenue in July of 2020, with Churchill charged with murder and firearms offences a year later.
He remains free on bail, with the preliminary inquiry set for June.
