The province’s top court will take a couple of weeks to render its ruling in the case of Nicholas Villeneuve.
Villeneuve was 21 in 2019 when his vehicle collided with another near Gander, killing two people and seriously injuring two others.
He was charged with eight counts including impaired driving causing death and impaired causing bodily harm. But he was acquitted after the judge ruled his rights were violated in the immediate aftermath of the fiery, head-on collision. The Crown appealed, and yesterday three Court of Appeal justices heard arguments from both sides. They reserved a decision with no specific date given for its release.
Josh Whiteway, who was left paralyzed from the waist down, was in the courtroom with his mother yesterday.
Whiteway was in the back seat of the second vehicle with his girlfriend, Suzanne, who was also seriously injured. Up front were her parents, John and Sandra Lush, who were both killed.
