Lawyers for two companies charged in a workplace mishap near St. John’s in July of 2020 were back in court today.
The incident occurred on a grey showery day in a warehousing yard off Fowler’s Road.
A worker was doing repairs underneath a 7-tonne forklift, when a part of it fell on him, causing serious injuries, including a partially-severed hand, which he continues to recover from.
Eight months after the incident, the worker’s employer, Nova Scotia-based Hurricane Industrial Equipment, as well as Blue Water Agencies of C.B.S., where the incident occurred, were each charged with two violations of the Occupational Health and Safety Act.
However, six additional charges against the employer have since been added to the court docket.
They include failing to provide a safe workplace and proper supervision, and “failing to securely block an elevated part of mobile equipment”.
The worksite itself has acted primarily as a storage and warehouse site for the Hibernia project.
The case was set to proceed today but it was postponed to give a new Crown attorney time to get up to speed.
The matter is due back in court in mid-November.
