The province is seeking input on proposed changes to the Lands Act as it related to so-called squatter’s rights.
The changes to section 36 of the Act are being considered to clarify adverse possession of Crown land and protect the land interests of residents.
The amendments include changing the possession period of land from 20 continuous years prior to January 1 of 1977 to ten continuous years prior to the same date.
It also sets a definitive time period within which a person can make claims to Crown lands based on adverse possession among other changes.
Settlement, particularly in older communities in rural parts of the province, often happened generations ago with no formal documentation, leading to clashes when questions are raised about who owns what.
Minister responsible, Derrick Bragg says they’ve posted the proposed legislative changes online and are encouraging residents to provide their input.
They’re looking at a way to clear up some of the confusion says Bragg. Another option is enabling Crown Lands to provide a legal document to land owners establishing their rights to particular piece of property.
