The National Parole Board’s decision to revoke Philip Pynn’s parole has been upheld by the appeals board.
Pynn, who was convicted in the shooting death of his friend, Nick Winsor, was on statutory release last spring when a urinalysis detected morphine and cannabis in his system. He explained that he and a woman went to a person’s house and smoked a bong before he became aware of its contents.
The Appeal Division found that the Parole Board did not base its decision on erroneous or incomplete information; rather, the information was relevant and reliable.
Pynn was under order not to consume drugs other than those prescribed to him, and not to associate with anyone involved in criminal actvity. Morphine is an ilicit drug, therefore, anyone who has it is presumed to be involved in criminal activity.
Pynn remains in prison.
