The Privacy Commissioner has made a ruling in a recent case involving a complaint regarding an ATIPP request seeking correspondence between the Premier’s Office and the Chief Electoral Officer.
While Michael Harvey found that the Premier’s Office properly withheld portions of responsive records, the office failed to respond within the statutory deadline of 20 days and failed to respond to the complainant without delay and in an “open, accurate, and complete manner.”
The Premier’s Office sought more time to respond to the ATIPP request citing COVID restrictions that required people to work from home, but the Privacy Commissioner felt the rationale was insufficient and the extension was denied.
