The appeal process is now underway for a former high school teacher and coach convicted of sexual assault.
Forty-year-old Noel Strapp was convicted last year and sentenced to four years in jail for offences against a former student at Roncalli High in Avondale between 2014 and 2016.
Yesterday, Strapp’s lawyer, Ian Patey, outlined what he says are five grounds for appeal in the case, mainly focusing on elements of evidence and testimony that he believes were not properly considered by the judge in making the decision.
Patey concluded that there were “flaws in the process” and that “a new trial is warranted.”
The Crown was given an opportunity to respond, arguing in favour of the process and the final decision concluding that the defence “just doesn’t like the judge’s finding, and that’s not grounds for appeal.”
The three Appeal Court judges assigned to the case say a written decision on the matter will be received “in due course.”
