The FFAW is offering further clarification for members following a Supreme Court injunction granted last week.
The union says the decision from the Standing Fish Price-Setting Panel remains in effect, meaning that a collective agreement is considered to be in place.
Under provincial legislation, the cessation of business or a strike cannot be authorized or declared by the union or its representatives while that agreement is in place.
The union says individual harvesters can make their own decisions on whether or not to fish.
The union recognizes that the situation is frustrating for many harvesters, and while it is not a resumption of collective bargaining, it continues to have open communication with government and ASP on ways to improve the situation.
