The province’s Supreme Court has dismissed an attempt at a class-action lawsuit against the government over pandemic travel restrictions.
Special Measures Orders introduced in May 2020 limited travel in and out of the province to permanent residents and essential workers.
An Ontario couple with a home and seasonal business in Newfoundland argued that violated their Charter rights to mobility, equality, and freedom of expression, however, Justice Daniel Boone dismissed the application, saying there was no viable cause from the action, nor was there any claim that government abused its power, acted in bad faith or with disregard for their Charter rights.
The judge also noted that the application didn’t identify a particular class of people who would be part of the court action.
