Kurt Churchill makes his bid for bail this morning with a lawyer who once represented the man he’s accused of killing.
Churchill has been charged with second-degree murder in the shooting death of James Cody on July 5, 2020.
The application for interim release comes a day after the Supreme Court ruled it was ok for renowned Toronto lawyer Frank Addario to represent Churchill in the murder case.
Justice Kendra Goulding dismissed the Crown’s contention of a conflict of interest, saying a reasonably informed person would not perceive a conflict based on the facts, most of which are banned from publication pending a trial.
But it is known Addario briefly represented Cody four years ago before the Supreme Court of Canada over unrelated trial delays.
Addario boasts more than 40 appearances as counsel before that court. He’s also a director of the Canadian Civil Liberties Association, an advisor with the Supreme Court Advocacy Institute and a past President of the Criminal Lawyers’ Association, which he has also represented in petitions before the top court.
Addario’s newest client is accused of gunning down his former client on Craigmillar Avenue in July of 2020.
Churchill was arrested in Toronto three months ago, was returned to the province, and has been at Her Majesty’s Penitentiary ever since.
He has repeatedly stated his eagerness to be released until his trial. His bail hearing is expected to last two days.
