Lawyers for several current and former MHAs are in Supreme Court today seeking to have a lawsuit against them dismissed.
Former premier Dwight Ball and the province’s commissioner for legislative standards, Bruce Chaulk, is also part of the action to dismiss the statement of claim brought by MHA Eddie Joyce.
Joyce was at the centre of harassment allegations made by Sherry Gambin-Walsh in 2018. He was turfed from cabinet and the Liberal caucus and later disciplined by the House of Assembly.
Joyce subsequently filed the defamation lawsuit against several players in the scandal over the handling of the harassment complaint.
Lawyers for Ball, Chaulk, Gambin-Walsh and others say the suit should be dismissed, arguing that materials and evidence collected during the harassment investigation are protected by parliamentary privilege and should not be disclosed through the court process.
They want the statement of claim either thrown out or for them to be removed from the action.
Arguments by more than a half dozen lawyers continue today and tomorrow before Supreme Court Justice Sandra Chaytor.
