A judge himself apologized today to the family of a woman who died at the hands of her own grandson, who he then sent to prison.
Justice Peter O’Flaherty sentenced Brandon Tobin to five years for manslaughter in the death of 82-year-old Mildred Brake just over four years ago.
Tobin, now 31, attacked his grandmother in the home they were sharing on Mitchell Court in March of 2022. He had a mixture of drugs in his system, causing seizures and violence which the Crown said was both foreseeable and preventable.
And in the end, the judge was inclined to agree, saying while there was no intent to kill, Tobin knew his actions had that potential from his criminal and medical history, adding “he is a violent man.”
But O’Flaherty devoted much of his decision to consoling Mildred Brake’s family, recognizing the profound and tragic loss of someone who cared so much for others.
“There was kindness in everything she did,” said the judge. “Many loved her, many more appreciated her. The family is left with a permanent hole in their hearts. I’m sorry.”
In sentencing Tobin, the judge noted he also expressed remorse, and pleaded guilty, sparing everyone a difficult trial.
With time already served, Tobin has about three years left in jail.
