The Supreme Court of Newfoundland and Labrador has dismissed an application objecting to the sale of religious articles from the Roman Catholic Episcopal Corporation of St. John’s, to its successor the Archdiocesan Renewal Corporation.
The items were sold by the episcopal corporation to ARC for $10,000 for use in other church buildings.
The sale was part of assets of the Church that were to be used to compensate victims of physical and sexual abuse for which the corporation was liable.
A claimant opposed both the sale and lease agreement and filed an application claiming that the transaction was entered into unfairly.
The Court dismissed the interlocutory application and found that the $10,000 ARC agreed to pay was a fair value for the religious articles. The Court also rejected the claimant’s submission that the episcopal corporation relied on Canon Law to exclude the religious articles from its assets.
