The second-degree murder case against Kurt Churchill was called in provincial court this morning.
But a dispute over the amount of evidence provided to his defence lawyers prevented setting dates for the preliminary inquiry.
Churchill is accused in the July 2020 shooting death of James Cody on Craigmillar Avenue in St. John’s.
He was granted bail in early October but was in court this morning to hear the latest developments first-hand.
The Crown expressed concern over delays getting the case to trial, but the defence said it has concerns of its own with receiving disclosure from the Crown. As a result, a focus hearing to settle the ‘he-said-she-said’ was set for November 30.
That’s expected to be followed the next day with dates for the preliminary inquiry, where it will be determined if there’s enough evidence to go to trial.
Aside from the murder charge, Churchill also faces numerous firearms offences in connection with the shooting.
