A local mechanic has been sentenced for the lesser role he played in a fatal crash on Peacekeepers Way almost two years ago.
Sixty-nine-year-old Terry Barry was one of three people charged after the collision between a car and a big rig cab that was hauling a trailer.
The driver of the car, a 56-year-old man, died at the scene, while the truck driver, Sam Tessier, was treated in hospital.
It was later alleged that mechanical issues contributed to the June 2022 crash, leading to charges against Tessier, Terry Barry and garage owner Cec Walsh.
Barry had nothing to do with the crash itself, but he did sign off on dozens of other illegal inspections as a “favour” to Walsh. Barry’s lawyer told the court her client was “thrown under the bus” by Walsh.
Barry had faced 39 counts of forging documents, but ended up pleading guilty to 13.
He also pleaded ignorance, saying he didn’t know what he did was wrong. But with decades of experience as a journeyman mechanic, the judge said he should’ve known, and gave him a suspended sentence with a year of probation.
That means Barry will have a criminal record. He had sought an absolute discharge, which comes with no criminal record, saying anything more would cost him his current job.
Tessier, meanwhile, faces a single count of criminal negligence causing death, while Walsh also faces that charge, plus 58 counts of fraud over $5,000, 19 counts of forging documents, 17 for breaking court conditions, and one count of assault.
They’re both due back in court on March 4.
