A St. John’s man convicted of second degree murder will get a new trial.
Craig Pope was convicted after Jonathan Collins was stabbed to death in the Mundy Pond area. Collins’ appeal was based on the judge’s instructions to the jury.
Pope and Collins got into a fistfight after getting out of a taxi in a dispute over $60. Collins was rushed to hospital but died from blood loss.
Justices Welsh and Butler conclude that the trial judge erred in their instructions by not sufficiently explaining the difference between manslaughter and murder regarding the question of intent. Justice Goodridge filed a dissenting opinion.
