The province’s Supreme Court has ruled that Kurt Churchill can be represented by the same lawyer who once defended the man he’s accused of killing, James Cody.
Toronto lawyer Frank Addario briefly represented Cody four years ago before the Supreme Court of Canada, over unrelated trial delays.
The Crown filed an application opposing Addario being retained by Churchill, citing potential conflict of interest.
But Justice Kendra Goulding today dismissed the application, saying a reasonably informed person would not perceive a conflict.
The rest of her reasons, including specific details of Cody’s shooting, are banned from publication.
Churchill is accused of gunning down James Cody on Craigmillar Avenue last year.
He was arrested in Toronto three months ago, was returned to the province, and has been at Her Majesty’s Penitentiary ever since.
Tomorrow, his new lawyer, Frank Addario, will apply for bail on his behalf.
