A man charged with trying to help his brother escape after a fatal shooting in St. John’s six months ago is going straight to trial.
Twenty-three-year-old Hussein Hussein is formally charged with accessory to murder after the fact, and resisting or obstructing police.
He and his brother, 20-year-old Ibrahim Hussein, were arrested after 33-year-old Gerald Kyle “Scrappy” Hynes was gunned down in April on Watson Street.

They were on the run for two days before being caught in the Marine Atlantic parking lot at Port aux Basques, with the younger brother found hiding in the trunk of the getaway car.
Hussein Hussein was released on bail in May, and had a preliminary inquiry set for this week. But in a surprise move, the Crown filed a direct indictment, skipping the preliminary hearing and moving right to trial.
Ibrahim Hussein, who remains in custody facing the most serious charge on the books – first-degree murder – waived his right to a preliminary inquiry, and is also awaiting trial dates.
He’s also charged with several gun offences and a dozen other offences including assault, uttering threats and failing to follow court orders.
Both men are expected to be arraigned in Supreme Court in early December.
Three others are also facing charges of helping the accused shooter and driver get away.
Two women and a man were charged in October with accessory after the fact to murder.
